Apx GmbH ("us", "we", or "our") operates the https://apxacademy.com and https://apxsquad.com websites, as well as the Apx Training App (together the "Platform"). This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

1. Preamble and Scope

This Privacy Policy (the "Policy") governs the collection, processing, and use of personal data by Apx GmbH (the "Controller," "we," "us," or "our") in connection with the digital services offered under the brand Apx Academy, in particular the free learning platform "Apx Squad," the paid training membership "Apx Training," and the associated website (collectively, the "Platform"). By accessing, registering for, or using the Platform, you acknowledge that you have read and understood the practices described herein.

This Policy applies to all users of the Platform. Please note that certain services of the Platform are provided through third-party software or platform providers. These providers may process personal data in connection with the technical provision of their services. We have no control over the data processing practices of such third-party providers insofar as they act as independent controllers under applicable data protection law.

3.Eligibility and Minors

The Platform is intended solely for users aged thirteen (13) years or older. We do not knowingly collect personal data from children under the age of 13. If we become aware that we have collected personal data from a child under 13, we will take steps to delete such information immediately.

Users between the ages of 13 and 17 represent and warrant that they have obtained the permission of a parent or legal guardian to use the Platform. Parents are encouraged to monitor their children’s usage, particularly with regard to the use of learning content, training plans, onboarding features, and any interactive or community-related functions that may be made available through the Platform.

4. Collection of Data

We collect data to provide, personalize, and improve our services. The categories of data collected are as follows:

4.1. Account and Identity Data Upon registration, we collect personally identifiable information provided by you, including your email address, name, login credentials, and any other account information required for access to the Platform. If registration or login is facilitated through third-party services or providers, we may also collect the authentication information and basic profile data authorized by you through such provider.

4.2. Onboarding and Personalization Data To customize the coaching experience, we collect information regarding your athletic profile, including but not limited to your sport, position, level of play, and training goals.

4.3. Learning, Engagement, and Conversion Data We automatically track your interactions within the Platform in order to measure engagement, improve the user experience, and understand the effectiveness of our services. This may include information about registrations, onboarding progress, consumed learning content, selected learning paths, activation events, email interactions, responses to segmentation processes, and indications of interest in paid services.

4.4. Training and Progress Data In connection with the use of "Apx Training", we may collect information relating to your training activity and progress, including training plans used, completed activities, tracking data, nutrition-related inputs, and other information you provide or generate through the training membership.

4.5. Technical and Device Data We collect technical information in connection with your use of the Platform, including IP address, browser type, device type, operating system, time zone settings, and other technical information necessary for the secure delivery and optimization of the Platform.

5. Purpose and Legal Basis for Data Processing

We process your data for the following purposes based on the associated legal grounds under the GDPR:

  • Contractual Performance (Art. 6(1)(b) GDPR): To register and authenticate your identity, manage your user account, provide access to "Apx Squad Learning" and "Apx Training", process onboarding and personalization inputs, deliver learning content, training plans, and other core functionality of the Platform, and manage paid memberships or other services booked by you.

  • Legitimate Interests (Art. 6(1)(f) GDPR): To analyze platform performance, improve our services, personalize the user experience, manage customer relationships, prevent fraud, ensure network and information security, and evaluate the effectiveness of our onboarding, activation, and service processes.

  • Consent (Art. 6(1)(a) GDPR): For the use of optional tracking technologies, marketing communications, email automations, nurture sequences, and other promotional communications relating to our services, insofar as such processing is based on your consent. You may withdraw consent at any time.

6. Data Sharing and Third-Party Recipients

We do not sell your personal data. However, we may share data with trusted third-party service providers to facilitate App operations.

6.1. Learning Platform, CRM, and Email Automation We utilize Simplero as the provider of the free learning platform "Apx Squad Learning" and for related functions such as registration, educational content delivery, onboarding, segmentation, email marketing, automations, and customer relationship management. In this context, personal data may be processed through Simplero to provide and manage these services. Simplero describes its platform as providing courses, community, email, CRM, payments, and automations in one place.

6.2. Training Platform Provider We utilize Everfit as the provider of the paid membership "Apx Training". In this context, personal data may be processed through Everfit in connection with training plans, progress tracking, nutrition-related features, community functions, and other training services made available through the Platform. Everfit states in its privacy materials that, in trainer-client contexts, it acts as a processor for certain personal data processed through its platform.

6.3. Analytics, Marketing, and Communication Providers We may share personal data with service providers that support analytics, communications, customer management, and marketing activities, insofar as this is necessary to operate, analyze, improve, and promote the Platform and insofar as such processing is permitted under applicable law or based on your consent.

6.4. Payment Processing Payments for paid memberships or other paid services are processed via the payment tools integrated into Simplero and, where applicable, through the payment processors or gateways connected thereto. Simplero states that its payment functionality integrates with Stripe, PayPal, and numerous other gateways. We do not collect, store, or process full payment card details except insofar as necessary through the payment infrastructure provided by such service providers.

6.5. Infrastructure and Technical Service Providers We may also share personal data with hosting providers, cloud infrastructure providers, IT service providers, and similar technical recipients insofar as this is necessary for the secure provision, maintenance, and operation of the Platform.

6.6. Coaches, Experts, and Premium Service Providers Insofar as the Platform facilitates or provides optional premium services, one-on-one coaching, custom programming, form review, direct coach access, or similar higher-touch services, we may share limited personal data with the respective coaches, experts, or other service providers to the extent necessary for the provision of such services. Such access shall be limited to the data required for the relevant service.

7. International Data Transfers

Certain service providers used in connection with the Platform, in particular providers supporting "Apx Squad Learning", "Apx Training", analytics, communications, or technical infrastructure, may process personal data in the United States or other jurisdictions outside the European Economic Area (EEA). In such cases, we ensure that appropriate safeguards are in place, specifically through the use of Standard Contractual Clauses (SCCs), adequacy decisions adopted by the European Commission, such as the EU-U.S. Data Privacy Framework where applicable, or other lawful transfer mechanisms under the GDPR.

8. Data Retention

We retain your personal data only for as long as your account remains active or as long as such data is necessary for the purposes described in this Policy, in particular for the provision of "Apx Squad Learning", "Apx Training", onboarding, personalization, customer management, and related services. Upon your request to delete your account, or if your account is otherwise terminated, your personal data will be permanently deleted or anonymized, except where retention is required by law or necessary for the establishment, exercise, or defense of legal claims, or for compliance with tax, accounting, or other statutory obligations.

9. App Permissions

To enable specific features of the Platform or of third-party services used in connection with the Platform, access to certain device or browser permissions may be requested, including Camera, Microphone, Photo Library, Push Notifications, or similar functions. Such permissions are optional and will only be used insofar as necessary for the relevant feature or service made available to you.

These permissions can generally be granted, managed, or revoked at any time via your device settings, browser settings, or the settings of the respective third-party provider.

10. Your Rights

11. Aggregated Data

We reserve the right to collect, use, and share aggregated, anonymized data (data that cannot be used to identify you) for any business purpose, including but not limited to analytics, service improvement, research, marketing, and the further development of our Platform and related services.

We reserve the right to modify this Policy at any time. Material changes will be communicated through the Platform, the website, or by email where appropriate. Your continued use of the Platform following the changes constitutes acceptance.
